These terms and conditions apply to the use of this web site, including the purchase of goods or services over this web site. In using this web site for these or any other purposes, you agree to be bound by these terms and conditions. Terms Used

In these terms and conditions, the expressions ‘we’, ‘us’ and ‘our’ are a reference to Three Dukes International Trading Limited, trading as Bizmate, owner and operator of the www.rotoruabizmate.co.nz website. ‘The seller’ refers to ‘Three Dukes International Trading Limited. ‘The buyer’ refers to any legal entity purchasing from the seller.

Formation of Contract

Our website and advertising only constitute an invitation to treat. Ordering goods (online or otherwise) constitutes an offer by the buyer to buy in accordance with these terms and conditions. Our acceptance occurs (and the contract is formed) when the goods are despatched to the seller.

Ordering Process

  • You may offer to purchase goods or services described on this web site for the price specified on this web site.
  • Your order must contain your name, email address and any other ordering information specified on this web site.
  • Within seven days of receipt of your order, we will at our discretion accept or reject your offer to purchase.
  • You may not cancel an order once it has been submitted, even if our acceptance or rejection of your offer is still pending.
  • We are not required to give reasons for rejecting your offer to purchase.
  • If we reject your offer to purchase the goods or services for any reason, neither of us will be under any further liability to the other arising out of your original offer or our non-acceptance of that offer.
  • If we have not responded to you within seven days, your offer will be deemed to be rejected.
  • We give no undertaking as to the availability of products advertised on this web site.
  • Delivery of the goods or supply of the services to you will be effected in the manner described on this web site.
  • Title in the goods does not pass to you until payment has been received in full.
  • Risk of loss or damage to the goods passes to you upon dispatch.
  • Unless otherwise displayed all transactions are processed in NZD.
  • The goods and services are offered for sale only to persons who can make legally binding contracts.

Order Delivery

We reserve the right to despatch the your order in one delivery or by installment. Failure to deliver any installment shall not entitle the buyer to repudiate the contract as to any installments already delivered. Any quotations of delivery times by Bizmate are made in good faith but are estimates and we shall not be bound by such quotation. Standard order dispatch timeframes are between 1-2 business days. Shipping times are estimated at between 2-4 business days depending on your location. If for any reason we are unable to dispatch your order we will notify you within 24 hours to arrange an agreeable alternative item, a backorder or a full refund.

Shortages, Damages or Loss in Transit

Liability for shortages in the quantity of goods delivered is limited to making up the shortages. No claim for shortages in quantity will be allowed unless the customer gives notification of the shortage in writing within 7 days of the delivery and provides a reasonable opportunity for us to investigate the claim. Goods leaving our premises are adequately packed. Claims for damage or loss in transit must be made against the carrier in the prescribed manner: Prior to acknowledging delivery to the carrier you must ensure that the complete consignment as per the carrier’s note has been received. Should there be a shortage or visible damage to outer packaging the carrier’s note must be endorsed accordingly. Within 7 days of receipt of consignment you must ensure that all goods received are in good order and condition. No claims will be considered after 7 days of receipt of goods. While no liability for goods damaged or lost in transit will be accepted by Bizmate, details of any claim should be advised to us.

Return of Goods for Credit or Refund

Goods supplied in accordance with your order can only be returned with our express approval. Requests to return goods must be submitted within 14 days from the date of supply and the original invoice number must be quoted. Goods must then be returned to our warehouse within 7 days of us agreeing to credit or refund the goods. If they are returned later than this, we will not be able to process this request. Where goods are accepted (for credit or refund at our discretion) they must be delivered at your expense into Bizmate store in original condition and packaging. We reserve the right to levy a restocking fee against any returns. Such fees may be up to 20% of the invoice price and levied at our absolute discretion.
